1. Scope of the General Terms and Conditions of Sale
These general terms and conditions of sale (hereinafter referred to as "GTC") express the entirety of the obligations of the parties. In this sense, the consumer is deemed to accept without reservation all the provisions provided in these general terms and conditions of sale. LE COLONEL MOUTARDE commits itself to respect its role as a reseller within the framework of these conditions.
These GTC may be modified and/or updated. The GTC applicable to an order are those in force on the day of the order.
These GTC aim to specify the rights and obligations of the parties in the context of online sale of goods and services offered by LE COLONEL MOUTARDE to the customer.
They constitute the contractual framework of the sale with the order form, confirmation emails, automatic recording systems used by the site, and the invoice.
2. Acceptance and Validation of the Order
The automatic recording systems are considered as proof of the nature, content, and date of the order.
The order process involves validating a shopping cart by clicking on the "Cart" button located at the top right. A summary screen of the order is then offered to the customer who must confirm their order by clicking on the "Validate" button. This step constitutes the customer's irrevocable acceptance which can only be challenged in the cases specifically provided for in these general terms and conditions of sale as "right of withdrawal" and "out of stock."
The customer is then directed to secure online payment sites.
The order is final only after full payment of the price.
Non-compliance with the various stages of the order procedure will result in the invalidity of the order and its rejection. The information stated by the buyer when taking the order commits the latter: in case of error in the wording of the recipient's details, LE COLONEL MOUTARDE cannot be held responsible for the impossibility of delivering the product.
3. Product Availability
Orders will be accepted within the limits of available stocks. To this end, the customer is informed at the time of ordering on the site's information page describing each of the items of the availability of said item.
The offers contained on this site are valid as long as the products remain online and until stocks are depleted
LE COLONEL MOUTARDE cannot be held responsible for the non-performance of the contract concluded in case of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, in particular of postal services and transport and/or communication means, flooding, fire...
The order will be executed at the latest within 30 days from the day following the one where the order was definitively validated.
4. Information on Products
All products are described on the site in each product sheet. The photographs, videos, drawings illustrating the presented products are a reproduction intended to be as accurate as possible, but they do not have contractual value. The characteristics of each product are available on the corresponding product sheet. The customer is invited to read them before placing their order. The company LE COLONEL MOUTARDE cannot be held responsible for non-substantial errors that could affect the description and presentation of the products, their components, accessories, or materials.
LE COLONEL MOUTARDE guarantees the buyer, for hidden defects that may affect the delivered products, within the framework of a replacement of defective products, or parts making them unsuitable for their use, or their refund without being considered by the buyer as responsible for the possible consequential damages that these hidden defects could have caused. LE COLONEL MOUTARDE guarantees the products for a period of 2 months from the delivery date.
5. Prices & Rates
The prices are indicated in euros and are only applicable on the date of sending the order validation by the customer. The price indicated on the product sheets includes transportation. The price indicated in the order confirmation is the final price, expressed all taxes included and including VAT for France and the countries of the European Union. This price includes the price of the products, packaging costs, and transportation fees. The full payment must be made at the time of the order. The customer alone is responsible for verifying the possibilities of importing the ordered products in view of the law of the country of delivery.
6. Payment Method
The price of the products is payable in cash on the day of the actual order. Payment is made by debiting your PayPal account. The customer guarantees the company LE COLONEL MOUTARDE that they have the necessary authorizations to use the payment method chosen
